Terms of Service

1. Beta Status

Expedition is currently offered as a closed, invite-only beta to a limited group of users. By using it in this period, you understand and agree that:

• Features may change, be added, or be removed without notice.
• The service may be interrupted, reset, or discontinued at any time during the beta period.
• We make no guarantee of data permanence during beta — while we do not intend to lose your data and back up our systems in the ordinary course of operation, beta software carries more risk of bugs and data loss than a finished product, and you should not treat it as a permanent, guaranteed record.
• Beta-tier access to features that will eventually require a paid subscription is granted at no cost, for the duration of the beta, at our discretion, and may be modified or revoked when the beta ends.

2. Eligibility

You must be at least 13 years old to use Expedition. If you are located in a jurisdiction that sets a higher minimum age for consent to online services without parental involvement, you must meet that jurisdiction's minimum age instead. We do not knowingly permit anyone under these minimums to create an account.

3. Your Account

• Expedition currently uses Sign in with Apple as its sole authentication method. You are responsible for maintaining the security of the Apple ID associated with your account.
• One account per person. Account sharing or transferring your account to another person is not permitted without our consent.
• You're responsible for all activity that occurs under your account.
• You can permanently delete your account and associated data at any time from Settings. If you are the sole member of a squad, that squad is deleted with your account; otherwise, squad ownership transfers automatically so your squadmates are unaffected. See our Privacy Policy for what this deletion does and does not remove.

4. Subscriptions and Payments

Expedition currently offers free-tier access with a limit on the number of active habits. During the beta period described in Section 1, some or all users may be granted expanded access at no charge, at our discretion.

We do not currently charge for any feature of Expedition. Before we introduce any paid subscription, we will update these Terms with the specific price, billing frequency, free trial terms (if any), and cancellation instructions, consistent with Apple's App Store requirements, and we will notify active users of the change before it takes effect. Any future subscription will be billed through your Apple ID account and can be managed or cancelled through your device's subscription settings.

5. User Content

Expedition includes fields you and your squadmates control — your username, habit names, and squad name — which may be visible to other members of your squad. You retain ownership of the content you create. By entering it, you grant Egg Hatch a limited license to store, display, and process that content solely as necessary to operate the app (for example, showing your habit name to your squadmates, or your username on the trail).

You agree not to use Expedition to post or transmit content that is:

• Abusive, harassing, hateful, or threatening toward another person.
• Sexually explicit or otherwise inappropriate for a general audience.
• Impersonating another person or entity in a misleading way.
• Otherwise illegal or in violation of a third party's rights.

We reserve the right to remove content and to suspend or terminate accounts that violate this section, with or without prior notice.

6. Acceptable Use

In addition to Section 5, you agree not to:

• Attempt to circumvent any feature limit, paywall, or access control within the app.
• Reverse engineer, decompile, or attempt to extract the source code of the app, except where applicable law gives you the right to do so despite this restriction.
• Use automated means (bots, scrapers) to access or interact with the app.
• Interfere with or disrupt the app's servers or infrastructure.
• Use the app for any purpose that violates applicable law.

7. Intellectual Property

Expedition's app, design, branding, and underlying code are owned by Egg Hatch, LLC and protected by applicable intellectual property law. These Terms do not grant you any right to use Egg Hatch's or Expedition's trademarks, logos, or branding without our prior written consent.

8. Termination

You may stop using Expedition and delete your account at any time (Section 3). We may suspend or terminate your access to Expedition, with or without notice, if we believe in good faith that you've violated these Terms, engaged in conduct harmful to other users or to Expedition, or if we discontinue the service. Sections of these Terms that by their nature should survive termination — including Sections 7, 9, 10, 11, 12, and 13 — will survive.

9. Disclaimers

EXPEDITION IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DATA LOSS WILL NOT OCCUR, PARTICULARLY DURING THE BETA PERIOD DESCRIBED IN SECTION 1.

10. Apple App Store Terms

If you downloaded Expedition from the Apple App Store, the following additional terms apply and take precedence over anything in these Terms that conflicts with them:

• This agreement is between you and Egg Hatch, LLC only — not with Apple. Egg Hatch, not Apple, is solely responsible for Expedition and its content.
• Your license to use Expedition is a limited, non-transferable license to use it on Apple-branded devices that you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions.
• Apple has no obligation to provide any maintenance or support for Expedition. Any support we provide is described in Section 16 (Contact).
• Apple has no warranty obligation of any kind for Expedition. Any warranty claim is between you and Egg Hatch, as set out in Section 9.
• Egg Hatch, not Apple, is responsible for addressing any claims relating to Expedition or your use of it, including product liability claims, claims that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar law.
• Egg Hatch, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of any claim that Expedition infringes a third party's intellectual property rights.
• By using Expedition, you represent that you are not located in a country subject to a U.S. Government embargo or designated a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• You must comply with any applicable third-party agreement (for example, your wireless data or carrier service terms) when using Expedition.
• Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple has the right to enforce them against you as a third-party beneficiary.
• Egg Hatch's name, address, and contact information are in Section 16.

11. Indemnification

You agree to indemnify, defend, and hold harmless Egg Hatch, LLC, its officers, members, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of Expedition; (b) your violation of these Terms; (c) content you submit through the app, including your username, habit names, or squad name; or (d) your violation of any law or of a third party's rights, including intellectual property, publicity, or privacy rights. We reserve the right, at our own expense, to assume the exclusive defense of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with that defense.

12. Dispute Resolution — Binding Arbitration and Class Action Waiver

Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court.

Agreement to Arbitrate. You and Egg Hatch agree that any dispute, claim, or controversy arising out of or relating to these Terms, your use of Expedition, or your relationship with Egg Hatch (a "Claim") will be resolved through binding individual arbitration, rather than in court, except as set out below.

Class Action Waiver. You and Egg Hatch agree that any arbitration or proceeding will be conducted only on an individual basis and not as a class, consolidated, or representative action. Neither you nor we may bring a Claim as a plaintiff or class member in any purported class, consolidated, or representative proceeding.

Small Claims Carve-Out. Either party may instead bring an individual Claim in small claims court, if the Claim qualifies for that court's jurisdiction.

Your Right to Opt Out. You may opt out of this arbitration agreement and class action waiver by sending written notice to legal@egghatch.studio within 30 days of first creating your account, from the email address associated with your Apple ID or the account itself, stating clearly that you wish to opt out of arbitration. If you opt out, this Section 12 will not apply to you, and either party may bring Claims in court as otherwise permitted by law.

Governing Law. These Terms, and any Claim not subject to arbitration or brought in small claims court, are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws principles.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EGG HATCH, LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING FROM YOUR USE OF EXPEDITION. TO THE EXTENT ANY LIABILITY IS NOT VALIDLY DISCLAIMED, EGG HATCH'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID EGG HATCH IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) $50. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

14. General Provisions

• Entire Agreement. These Terms, together with our Privacy Policy, are the entire agreement between you and Egg Hatch regarding Expedition, and supersede any prior agreements on this subject.
• Severability. If any provision of these Terms is found unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will stay in full effect.
• No Waiver. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
• Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction, including in connection with a merger, acquisition, financing, or sale of assets.
• Force Majeure. We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including natural disaster, war, act of government, labor dispute, or failure of internet, telecommunications, or hosting infrastructure we rely on.

15. Changes to These Terms

We may update these Terms from time to time. We'll update the date at the top for any revision, and for material changes — including any change to Section 12 — we'll provide at least 30 days' notice before the change takes effect, either in-app or by posting the update here. Continued use of Expedition after a change takes effect constitutes acceptance of the updated Terms.
